Jurisprudential Review of "Al-Talfiq Bin-ul-Mahahab"

Abstract

In the modern era, where the evolution of civilization, the diversity of modern problems and the abundance of new inventions have greatly affected other areas of life, there has also been significant increase in modern Shariah problems, for the solution of which  Islamic jurisprudence is secondary. The need and importance of sources, isthisan, istsalah, Masal-e-Mursala and Fiqh al-Maqasid etc. has increased much more than before. A link in this chain is Aftaa him Madhhab al-Ghir and al-Talfiq bin al-Mahahab. It is not related to any particular chapter, ut it is a principled and general discussion, its relation is wide ranging from fiqh al-Ibadat to fiq al Asra and Fiq al-Mu’ashrah to fiq al-Muamailat. Many other efforts have been made on the subject, but in this paper, an important topic of contemporary times, the integration found in Takaful has also been discussed, in the article under review, this “Al-Talifiq between the religious and the jurisprudential  status of the integration found in Takaful.”
